How Does Probate Work in Ohio?

In general, Ohio the probate process should begin very shortly after a person has passed on.The individual who was appointed to serve as the executor of the will is tasked with identifying and locating the deceased assets, as well as his debts. However, before that often arduous task can begin,  the required documents and paperwork must be filed with the local probate court where the decedent resided at the time of his death. Probate cases are handled at the county level.

Once your case is opened by the court and an executor is appointed, all relevant parties to the estate must be notified of the death and admission of the will to probate

If there are no objections, the probate process proceeds with the executor valuing the assets, paying the debts and distributing the assets in accordance with the terms of the will. The process is complete when all of the assets are transferred to the appropriate parties. This seemingly straightforward process can be complicated in many ways, for example, if the deceased died without executing a will, when a will is contested, when assets are difficult to locate or value, when debts exceed assets, or in cases where the heirs challenge the filings or distributions.
